What to do when a tree fallsMillstone Borough regulates tree removal under Section 30-106.1 of its development ordinance: a permit from the Environmental Commission for any tree over 6 inches DBH, with specimen and historic trees going to the Planning Board instead. In the riparian zone the ordinance bars cutting altogether beyond dead wood, safety pruning and invasive replacement, and on slopes over 15% no tree of 6 inches or more comes out without an approved woodland management plan. The fee is $15 plus a $250 escrow for each replacement tree required, and a permit cannot be refused for up to two trees per lot per calendar year provided they are not specimen trees and not on slopes over 15%, in wetlands, a transition area or a stream buffer.
The codified text we work from is current through March 2023. Millstone has been active on tree rules since, so before you file we confirm with the Borough Zoning Officer that no later amendment changes the fee or the replacement schedule.
